The Party Wall etc. Act 1996
The Party Wall Etc. Act 1996 will nearly always apply to construction works carried out at a property in close proximity to other buildings and will apply where these works include the following factors:-
- Excavations near a neighbours property or structure.
- Construction works to a boundary position.
- Construction works affecting a dividing wall (party wall), floor or chimney between your property and your neighbour.
The Act places a legal obligation on all property owners carrying out work to which the Act applies, to serve advanced legal notice to the neighbours affected prior to works commencing.
